Device Protection Plan Terms of Service

Effective Date: March 1, 2026

The Device Protection Plan (“Plan”) is offered by 1804282 Ontario Limited, operating as GymNext (“GymNext,” “we,” “our,” or “us”), a corporation organized under the laws of Ontario, Canada.

By purchasing, enrolling in, or maintaining a subscription to the Device Protection Plan, you (“Customer,” “you,” or “your”) agree to the following terms and conditions.


1. Program Effective Date

This Device Protection Plan becomes effective March 1, 2026.


2. Eligibility Requirements

2.1 Post-Warranty Eligibility Only

Devices are eligible for coverage only after the expiration of the original one (1) year limited manufacturer warranty.

2.2 Enrollment Window

Coverage does not automatically begin after the 1-year warranty expires.

To be eligible, the Plan must be purchased:

  • Within three (3) months of the expiration of the original 1-year warranty; OR

  • Within six (6) months of March 1, 2026 (the introduction of this program),

whichever applies.

Devices enrolled outside these windows are not eligible for coverage.

2.3 Device Registration Requirement

The device must be registered within the GymNext app using its serial number prior to or at the time of enrollment.

Coverage applies only to the registered serial number.

2.4 Geographic Eligibility

The Plan is available only in the following regions where GymNext ships products:

  • European Union member countries

  • United States

  • Canada

  • Australia

  • United Kingdom

GymNext reserves the right to modify eligible territories at its discretion.


3. Coverage Period

3.1 Coverage begins at the time the subscription is purchased.

3.2 Coverage remains active only while the subscription is current and in good standing.

3.3 If the subscription expires or is cancelled and not renewed, coverage immediately terminates.

3.4 Devices are not eligible for reinstatement outside the enrollment window described in Section 2.2.


4. Scope of Coverage

4.1 The Plan covers unexpected hardware failures and accidental damage arising from normal use.

4.2 Covered service may include, at the sole discretion of GymNext:

  • Replacement parts

  • Repair

  • Full device replacement (new or refurbished)

4.3 All determinations regarding repair, replacement, or parts provision are made at GymNext’s sole discretion.


5. Claim Limits

5.1 Coverage is limited to two (2) approved claims per registered device within any rolling twelve (12) month period.

5.2 After two (2) approved claims within a twelve (12) month period, additional claims may be approved solely at GymNext’s discretion.

5.3 Excessive, abusive, or fraudulent claims may result in denial of service or termination of coverage.


6. Exclusions

The Plan does not cover:

  • Damage resulting from negligence

  • Purposeful or intentional damage

  • Abuse or misuse

  • Unauthorized modifications or repairs

  • Cosmetic damage that does not impact functionality

  • Loss or theft

  • Damage caused by failure to follow operating instructions

GymNext retains sole discretion in determining whether damage falls within covered or excluded categories.


7. Claims Process

7.1 Submission Method

All claims must be submitted through the GymNext app. Claims submitted through other channels may not be processed.

7.2 Verification Requirements

All claims will be verified against the registered serial number. The serial number must match the enrolled device.

7.3 Required Information

Each claim must include:

  • Registered serial number

  • Current shipping address

  • Contact information, including email address

  • Photo evidence clearly showing:

    • The model and serial number label

    • The issue with the device

Video evidence is accepted and may be required.

Incomplete submissions may delay or result in denial of the claim.

7.4 Inspection

Customers may be required to ship the device to GymNext or an authorized service partner for inspection.


8. Replacement Devices

8.1 Return Requirement

If a replacement device is provided, the original device must be returned as instructed by GymNext.

Failure to return the original device may result in:

  • Charges equal to the replacement value of the device; and/or

  • Termination of coverage.

8.2 Transfer of Coverage

The replacement device assumes the remaining coverage of the original registered device.

8.3 No New Manufacturer Warranty

Replacement devices provided under this Plan do not receive a new one (1) year manufacturer warranty.

Replacement devices continue under the existing Device Protection Plan subscription and are subject to the same claim limits and coverage terms.

8.4 Claim Count Continuity

Replacement devices do not reset or restart the claim limit period. All prior approved claims within the applicable twelve (12) month period remain counted toward the two (2) claim limit.

8.5 Inventory Limitations

If device inventory does not allow for full replacement, GymNext may, at its sole discretion, provide replacement parts or repair services instead of a full device replacement.

8.6 Condition of Replacement Units

Replacement devices may be new or refurbished at GymNext’s sole discretion.


9. Shipping Policy

9.1 GymNext will use standard shipping methods for all parts, repairs, or replacement devices.

9.2 Expedited shipping services will not be provided under this Plan.

9.3 Shipping timelines may vary based on geographic location and inventory availability.


10. Program Termination

10.1 GymNext reserves the right to discontinue or terminate this Device Protection Plan program at its sole discretion at any time.

10.2 In the event of program termination, existing active subscriptions may be cancelled without refund.

10.3 Termination of the program does not obligate GymNext to provide future coverage beyond the effective termination date.


11. Limitation of Liability

To the maximum extent permitted by applicable law:

11.1 GymNext’s total liability under this Plan shall not exceed the original purchase price of the covered device.

11.2 GymNext shall not be liable for indirect, incidental, consequential, or special damages, including but not limited to:

  • Loss of revenue

  • Business interruption

  • Loss of training time

  • Loss of data


12. Termination & Cancellation

12.1 Coverage immediately terminates if the subscription expires or is cancelled and not renewed.

12.2 GymNext reserves the right to terminate coverage in cases of fraud, abuse, or material violation of these terms.

12.3 Cancellation of the subscription does not entitle the customer to retroactive coverage.


13. Modifications

GymNext reserves the right to modify these Terms of Service at any time. Updated terms will apply prospectively and will be made available through our website or app.


14. Governing Law

This Plan shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
